Welcome to Gymly! These Terms & Conditions ("Terms") govern your use of the Gymly mobile application and related services (collectively, the "Service") provided by Gymly ("we," "our," or "us"). By using our Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, accessing, or using the Gymly app in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. Your continued use of the Service constitutes acceptance of any modifications to these Terms. If you do not agree to these Terms or any modifications, you must immediately cease all use of our Service and delete the application from your device.

Binding Agreement: These Terms constitute a legally binding agreement between you and Gymly. By using our Service, you represent and warrant that you have the legal capacity to enter into this agreement and that you will comply with all applicable laws and regulations.

2. Description of Service

Gymly is a comprehensive fitness platform that provides:

Core Features:

  • Gym Discovery: Find and explore nearby gyms and fitness centers
  • Pass Management: Purchase, manage, and track gym memberships and passes
  • QR Check-in: Seamless gym check-in using QR codes or verification codes
  • Social Community: Connect with fitness enthusiasts, share achievements, and participate in challenges
  • Trainer Network: Discover and book sessions with certified fitness trainers
  • Progress Tracking: Monitor your fitness journey with detailed analytics and insights
  • Gift System: Send virtual gifts to support fellow community members

3. User Accounts and Registration

3.1 Account Creation

To use our Service, you must:

  • Be at least 13 years old (or the minimum age in your jurisdiction)
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use

3.2 Account Responsibilities

You are responsible for:

  • All activities that occur under your account
  • Maintaining the confidentiality of your password
  • Updating your account information when necessary

4. Health and Safety

Important Health Notice: Gymly is not a medical device or health service. Always consult with healthcare professionals before starting any fitness program, especially if you have medical conditions or concerns.

4.1 Health Information

When providing health information (height, weight, medical conditions, fitness goals), you agree that:

  • All information provided is accurate and current
  • You will update health information as it changes
  • You understand the risks associated with physical activity
  • You will seek medical advice when appropriate

4.2 Emergency Situations

In case of medical emergencies:

  • Contact emergency services immediately (911 or local emergency number)
  • Gymly may share your emergency contact information with gym staff
  • We are not responsible for medical emergencies or injuries
  • Always follow gym safety protocols and staff instructions

5. Gym Passes and Payments

5.1 Pass Purchases

When purchasing gym passes through Gymly:

  • All sales are final unless otherwise specified in writing
  • Passes are subject to gym availability, operating hours, and capacity limitations
  • Refunds are handled according to individual gym policies and applicable consumer protection laws
  • Prices may vary by location, pass type, and are subject to change without notice
  • Passes are non-transferable and non-refundable except as required by law
  • You are responsible for verifying pass validity and gym access before purchase

Important: Gym passes are subject to the terms and conditions of the individual gym facility. Gymly acts as a platform facilitator and is not responsible for gym operations, facility closures, or changes in gym policies that may affect your pass usage.

5.2 Payment Processing

We use secure payment processing through Razorpay:

  • All payments are processed securely and encrypted
  • We do not store your complete payment card information
  • You are responsible for all charges and fees
  • Disputed charges should be resolved with your payment provider

5.3 Pass Validity and Usage

Gym passes are subject to:

  • Expiration dates and time restrictions
  • Gym-specific terms and conditions
  • Capacity limitations and availability
  • Proper identification requirements

6. User Conduct and Prohibited Activities

6.1 Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful or malicious content
  • Attempt to gain unauthorized access to our systems
  • Interfere with the proper functioning of the Service
  • Create fake accounts or impersonate others
  • Spam or send unsolicited communications
  • Harass, abuse, or harm other users

When posting content on our platform, you agree not to share:

  • Use content for analytics and service improvement
  • Remove content that violates these Terms

10. Disclaimers and Limitations of Liability

We strive to provide reliable service, but we cannot guarantee:

  • Uninterrupted or error-free operation
  • Compatibility with all devices or operating systems
  • Availability of specific features or content

10.2 Health and Fitness Disclaimer

Gymly is not a medical or health service. We do not:

  • Provide medical advice or diagnosis
  • Guarantee fitness results or outcomes
  • Replace professional medical or fitness advice
  • Assume responsibility for injuries or health issues

10.3 Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Personal injury, property damage, or death arising from gym activities
  • Damages exceeding the total amount paid by you for the Service in the 12 months preceding the claim
  • Third-party actions, gym facility issues, or equipment malfunctions
  • Service interruptions, data loss, or system failures
  • Any damages resulting from your use of third-party services

Important Exception: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Gymly and its affiliates from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you post or share on the platform

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Deleting the app from your device
  • Contacting our support team
  • Using the account deletion feature in settings

12.2 Termination by Us

We may suspend or terminate your account if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Create multiple accounts or abuse our systems
  • Fail to pay required fees

12.3 Effect of Termination

Upon termination:

  • Your access to the Service will cease immediately
  • Your account data may be deleted
  • Active gym passes may be forfeited
  • Certain provisions of these Terms will survive

  • Pandemics, epidemics, or public health emergencies
  • Internet outages, power failures, or technical infrastructure issues

  • Gym facility closures or operational restrictions

In such circumstances, we will use reasonable efforts to minimize the impact and resume normal operations as soon as possible.

16. Severability

If any provision of these Terms is found to be unenforceable, invalid, or illegal by a court of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions will remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely approximates the intent of the original provision.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gymly regarding the use of our Service. These Terms supersede all prior agreements, representations, warranties, and understandings between you and Gymly, whether written or oral, relating to the subject matter hereof.

  • You must comply with all applicable business regulations, health codes, and safety standards
  • You agree to maintain appropriate insurance coverage and professional certifications
  • You are responsible for the accuracy of gym information, pricing, and availability
  • You must promptly notify us of any changes that may affect user access or safety

19.2 Minors

If you are under 18 years old:

  • You must have parental or guardian consent to use our Service
  • Your parent or guardian is responsible for your compliance with these Terms
  • We may require additional verification of parental consent
  • Certain features may be restricted based on age and local regulations
  • Health and fitness data collection may require additional parental consent
